TheThirdEye Gen website and related mobile platforms (collectively, the “Site”) is owned and operated by ThirdEye Gen, Inc. (“ThirdEye”). When you purchase products and services on our Site, we will ask you to provide the following personally identifiable information from you: credit card number, credit card expiration date, credit card cvv code and billing address. We do not store or process this information. This information is used by our third party payment processors to verify credit card authenticity and process payments for the products and/or services you purchased on our Site. Please note that the third party processor’s use of your personal information is governed by their respective privacy policies which may or may not contain privacy protections as protective as this privacy policy.

CHOICE AND OPT-OUT

You “opt-in” to having your information used for purpose of receiving marketing material from us, our affiliates, and/or our third-party advertisers when providing information to us.


If you no longer wish to receive promotional communications from us, our affiliates, and/or our third-party advertisers, you may opt-out of receiving them by following the instructions included in each communication. Please understand that if you choose not to receive promotional correspondence from us, we may still contact you in connection with your relationship, activities, transactions and communications with us.


From time to time, we may provide you the opportunity to participate in ThirdEye surveys and other information gathering activities to obtain information regarding the use of and possible changes to our products, services and/or the Site and the attractiveness of additional service features or new products or services. Participation in these surveys and activities is completely voluntary and you will usually be provided a choice to participate anonymously. Unique identifiers such as cookies (which are small text files stored locally on your computer that help store user preferences and may be html files, Flash files, or other technology), web beacons or clear gifs (which are small pieces of code placed on websites used to collect advertising metrics, such as counting page views, promotion views, or advertising responses , tags and scripts or similar technologies (collectively referred to as “Tracking Technologies”) are used by ThirdEye and our marketing, analytics, or other service providers to understand Site usage, help customize our content, offerings or advertisements on the Site, analyze trends, allow users to move between associated websites without logging into each site, and other purposes related to our management and administration of the Site. We may also use cookies to personalize your experience on the Site (e.g., to recognize you by name when you return to the Site), save your password in password-protected areas, save your online settings, enable you to use shopping carts on the Site, to help us offer you products, programs or services that may be of interest to you and to deliver relevant advertising. CHILDREN UNDER 13

Our Site is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Site. ThirdEye has implemented reasonable technical and organizational measures designed to deter unauthorized access to and use, destruction of, modification of, or disclosure of personally identifiable information we collect via the Site. Regardless of the precautions taken by us or by you, no data transmitted over the Internet or any other public network can be guaranteed to be 100% secure. We cannot ensure or warrant the security of any information you transmit to us and you provide all personally identifiable information via the Site at your own risk. You are responsible for maintaining the security of your user profile information, including your password and for any and all activities that occur under your account. Do not share this information with anyone. We will never ask you to send your password or other sensitive information to us in an email, though we may ask you to enter this type of information on the Site. ThirdEye may from time to time provide links to other websites that may have their own information collection practices. SOCIAL MEDIA FEATURES

The Site may include social media features, such as, for example: (1) the Facebook Connect service which gives you the option to post information about your activities on the Site to your Facebook profile page to share with your Facebook network, (2) the Share button which allows you to share a link to our Site with your friends on Twitter, Facebook, Linkedin and other social media platforms and by email, (3) the Tweet button, which allows you to share a link to our Site with your Twitter network, and (4) the ability to upload video, audio, and photographic material to our Site (collectively, “Social Media Features”). CALIFORNIA USERS/VISITOR

California Civil Code Section 1798.83 permits users who are California residents and who have provided with “personal information” (as that term is defined in Section 1798.83) to request certain information about the disclosure of that information to third parties for their direct marketing purposes. In addition, if you are under 18 years old, and a California resident, you may submit an application to have any content or material you posted or submitted to our Site using the Social Media Features removed from our Site. ThirdEye Gen, Inc GPS Tracking Data:

You'll see a request prompted by your device for permission to share your location information when you sign up for RespondEye, which includes location data collected via bluetooth and nearby wifi signals. As a default, for the best service available ThirdEye Gen, Inc product(s) may ask you to turn on location services " We use location data track distance and time of use”


We also use it to display user history in your receipts, to understand and resolve support tickets, to troubleshoot and solve software bugs.


If you're using an Android device, you have 3 location settings to choose from:


  • Allow all the time: We may collect location information at any time, even when you're not actively using the RespondEye application. If a service needs "Allow all the time" we'll ask for your permission when you enable the service.
  • Deny: This option disables location services for ThirdEye Gen, Inc’s RespondEye application. Location information will be collected from RespondEye during use of GPS and linked to your account.

You can always manage your location settings in your device's location preferences.


Sharing with Cities and Governments


In some instances, we're required to share information about the users service with tenants (Medical Partners) using RespondEye as a service.


To meet these requirements, we collect geolocation and timestamp data from the devices.

    ThirdEye Gen, Inc. collects:

    • Data provided by users to RespondEye such as during account creation
    • Data created during use of our services, such as location, app usage, and device data
    • Data from other sources, such as ThirdEye Gen, Inc partners and third parties that use ThirdEye Gen, Inc APIs

    1- Data provided by users. This includes:

    • User profile: We collect data when users create or update their RespondEye accounts. This may include their name, email, phone number, login name and password, address, profile picture, payment or banking information.For more information, please see the section titled “How we use personal data.”
    • Demographic data: We may collect demographic data about users, including through Hubspot CRM surveys. In some countries, we may also receive demographic data about users from third parties.
    • User content: We collect the information users submit when they contact ThirdEye Gen, Inc customer support, provide ratings or compliments for other users or restaurant partners, or otherwise contact ThirdEye Gen, Inc. This may include feedback, photographs or other recordings collected by users.

    2- Data created during use of our services. This includes:

    • Location data : ThirdEye Gen, Inc collects this data when the RespondEye app is running in the foreground (app open and on-screen) or background (app open but not on-screen) of their mobile device.
    • Location data (Tablets, Cell Phones (mobile devices), X2 MR Glasses. We collect precise or approximate location data from users and delivery recipients’ mobile devices if they enable us to do so. RespondEye collects this data from the time a user begins use of RespondEye and any time the app is running in the foreground of their mobile device. We use this data to enhance your use of our apps, including to improve location settings, enable safety features, and prevent and detect fraud.RespondEye collects user location data, and links location data collected during use with their account, even if the user has not enabled us to collect location data from their device. This enables us to offer services to the user like location generation and customer support.
    • Transaction information: We collect transaction information related to the use of our services, including the type of services requested or provided, number of calls, duration of calls, doctors and or paramedics online metrics and distance traveled.
    • Usage data: We collect data about how users interact with our services. This includes data such as access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and third-party sites or services used before interacting with our services. In some cases, we collect this data through cookies, pixels, tags, and similar tracking technologies that create and maintain unique identifiers.     • Device data: We may collect data about the devices used to access our services, including the hardware models, device IP address, operating systems and versions, software, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion data, and mobile network data.
    • Communications data: We enable users to communicate with each other and ThirdEye Gen, Inc through RespondEyes mobile apps and websites. For example, we enable users to call, text, or send other files to each other . To provide this service, ThirdEye Gen, Inc receives some data regarding the calls, texts, or other communications, including the date and time of the communications and the content of the communications. ThirdEye Gen, Inc may also use this data for customer support services (including to resolve disputes between users), for safety and security purposes, to improve our products and services, and for analytics.

    • Users participating in our referral programs. For example, when a user refers another person, we receive the referred person’s personal data from that user.

    • RespondEye business partners through which users create or access their RespondEye account, such as payment providers, social media services, or apps or websites that use ThirdEye Gen, Inc’s APIs or whose APIs ThirdEye Gen, Inc uses.

    We may use the data we collect to personalize the marketing communications that we send, including based on user location, past use of ThirdEye Gen, Inc services, and user preferences and settings.

    • Vendors that assist ThirdEye Gen, Inc to enhance the safety and security of its apps
    • Consultants, lawyers, accountants, and other professional service providers
    • Insurance and financing partners

    7- For legal reasons or in the event of a dispute

    ThirdEye Gen, Inc may share users’ personal data if we believe it’s required by applicable law, regulation, operating license or agreement, legal process or governmental request, or where the disclosure is otherwise appropriate due to safety or similar concerns.


    This includes sharing personal data with law enforcement officials, public health officials, other government authorities, airports (if required by the airport authorities as a condition of operating on airport property), or other third parties as necessary to enforce our Terms of Service, user agreements, or other policies, to protect ThirdEye Gen, Inc. rights or property or the rights, safety, or property of others, or in the event of a claim or dispute relating to the use of our services. If you use another person’s credit card, we may be required by law to share your personal data, including user information, with the owner of that credit card.

    This also includes sharing personal data with others in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.


    8- With consent

    ThirdEye Gen,Inc may share a user’s personal data other than as described in this notice if we notify the user and they consent to the sharing.

  5. Data retention and deletion

    ThirdEye Gen, Inc retains user data for as long as necessary for the purposes described above.


    Users may request deletion of their accounts at any time. ThirdEye Gen, Inc may retain user data after a deletion request due to legal or regulatory requirements or for the reasons stated in this policy.


    ThirdEye Gen, Inc retains user data for as long as necessary for the purposes described above. This means that we retain different categories of data for different periods of time depending on the category of user to whom the data relates, the type of data, and the purposes for which we collected the data.


    Users may request deletion of their account at any time by contacting Support@thirdeyegen.com


    Following an account deletion request, ThirdEye Gen, Inc deletes the user’s account and data, unless they must be retained due to legal or regulatory requirements, for purposes of safety, security, and fraud prevention, or because of an issue relating to the user’s account such as an outstanding credit or an unresolved claim or dispute. We retain User account and data for a minimum of 7 years after a deletion request. For Users, their data is generally deleted within 90 days of a deletion request, except where retention is necessary for the above reasons.

  6. Grounds for processing

    We only collect and use personal data where we have lawful grounds to do so. These include processing user personal data to provide requested services and features, for purposes of ThirdEye Gen, Inc legitimate interests or those of other parties, to fulfill our legal obligations, or based on consent.


    We collect and use personal data only where we have one or more lawful grounds for doing so. Such grounds may vary depending on where our users are located, but generally include processing personal data:


    A- To provide requested services and features

    In order to provide our services, we must collect and use certain personal data. This includes:

    • User profile data, which we use to establish and maintain user accounts, verify user identity, communicate with users about their accounts, and enable users to make payments or receive earnings
    • User location data, which we use to assist with navigation
    • Usage data, which is necessary to maintain, optimize, and enhance ThirdEye Gen, Inc services, including to determine incentives and calculate costs savings and location analytics
    • Transaction information
    • Information relating to customer support

    B- For purposes of the legitimate interests of ThirdEye Gen, Inc or other parties

    This includes using personal data to maintain and enhance our users’ safety and security. For example, we use personal data to prevent use of our services by users who have engaged in inappropriate or dangerous behavior, such as by retaining data of banned users to prevent their use of ThirdEye Gen, Inc product(s).


    This also includes purposes such as combating fraud, improving our services, direct marketing, research, and development, and enforcing ThirdEye Gen, Inc Terms of Service.


    In addition, it includes using personal data to the extent necessary for the interests of other people or the general public, such as in connection with legal or insurance claims, and to protect the rights and safety of others.


    C- To fulfill ThirdEye Gen, Inc’s legal obligations

    For example, ThirdEye Gen, Inc is subject to laws and regulations in many cities and countries that require it to collect and retain data about our users’ trips and deliveries, and to provide copies of such data to the government or other authorities. We collect and use personal data to comply with such laws.


    ThirdEye Gen, Inc may also share data with law enforcement regarding criminal acts or threats to public safety, or requests by third parties pursuant to legal processes. ThirdEye Gen, Inc may also share information with public health authorities where required or permitted by law.     D- With consent

    ThirdEye Gen, Inc may collect and use personal data based on the user’s consent. For example, we may collect personal data through voluntary surveys. Responses to such surveys are collected on the basis of consent and will be deleted once no longer necessary for the purposes collected.


    A user who has provided consent to a collection or use of their personal data can revoke it at any time. However, the user will not be able to use any service or feature that requires collection or use of that personal data.


3. Choice and transparency

ThirdEye Gen, Inc enables users to access and control the data that ThirdEye Gen, Inc collects, including through:

  • In-app settings
  • Device permissions
  • In-app ratings pages
  • Marketing opt-outs

ThirdEye Gen, Inc also enables users to request access to or copies of their data, changes or updates to their accounts, deletion of their accounts, or that ThirdEye Gen,Inc Restrict its processing of user personal data.


A- Privacy settings

Settings menus in the ThirdEye Gen, Inc product(s) for users give them the ability to set or update their location-sharing preferences and their preferences for receiving mobile notifications from ThirdEye Gen, Inc. Information about these settings, how to set or change these settings, and the effect of turning off these settings is described below.


  • Location data

    ThirdEye Gen, Inc uses device location services to enhance whenever they need one. Location data helps improve our services, including pickups, navigation, and customer support.


    Users may enable or disable ThirdEye Gen, Inc to collect location data from their devices through the Settings/ preference tabs available in ThirdEye Gen, Inc Product(s). Users can enable or disable such collections through the settings on their devices.

  • Share Live Location (users)

    Users who have enabled ThirdEye Gen, Inc to collect location data from their device may also enable ThirdEye Gen, Inc to share their location with partners from the time the user has enabled their settings.

  • Emergency Data Sharing (Users)

    Users who have enabled ThirdEye Gen, Inc to collect location data from their mobile device may also enable the Emergency Data Sharing feature that shares data with emergency police, fire, and ambulance services. Such data includes approximate location at the time the emergency call was placed. the First Responder or user’s name and phone number, pickup and dropoff locations.


    Users may enable or disable this feature using preferences


    ThirdEye Gen, Inc provides users with call analytics, status notifications and updates related to activity on their account. These notifications are a necessary part of using the ResondEye product for ThirdEye Gen, Inc and cannot be disabled.


    Users may enable ThirdEye Gen, Inc to send push notifications news from ThirdEye Gen, Inc.


B- Device permissions

Most mobile device platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without the device owner’s permission, and these platforms have different methods for how that permission can be obtained. iOS devices notify users the first time the RespondEye application and other ThirdEye Gen, Inc product(s) may request permission to access certain types of data and gives users the option to grant or refuse permission. Android devices notify users of the permissions that the RespondEye application and other ThirdEye Gen, Inc product(s) seek before their first use of the RespondEye application, and use of the accounts with grant of such permission.


C- Marketing opt-outs

Users may opt out of receiving promotional emails from ThirdEye Gen, Inc Here Users may also opt out of receiving emails and other messages from ThirdEye Gen, Inc by following the unsubscribe instructions in those messages. We may still send users who have opted out non-promotional communications, such as receipts for current or past services and or information about their account.


D- User data requests

ThirdEye Gen, Inc provides users with a variety of ways to learn about, control, and submit questions and comments about ThirdEye Gen, Inc's handling of their data. To make a request, please contact ThirdEye Support Here.

  • Accessing data: Users can ask for an explanation of the data we collect from them and how we use it.
  • Receiving data: Users can ask for a copy of data that ThirdEye Gen, Inc collects from them with their consent or as necessary to provide our services.
  • Changing or updating data: Users can edit the name, phone number, email address, payment method, and photo associated with their account through the Settings menu in the RespondEye application and other ThirdEye Gen, Inc product(s). They may also ask that ThirdEye Gen, Inc change or update their data, including if they believe such data is inaccurate or incomplete.
  • Deleting data: Users may request deletion of their account at any time by contact ThirdEye Support Here
  • Objections, restrictions, and complaints: Users may request that we stop using all or some of their personal data, or that we limit our use of their data. ThirdEye Gen, Inc may continue to process data after such objection or request to the extent required or permitted by law.In addition, depending on their location, users may have the right to file a complaint relating to ThirdEye Gen, Inc’s handling of their personal data with the data protection authority in their country. For example, users in the European Union and South America may submit such requests to the data protection authorities in the country in which they live.

We may occasionally update this notice. Use of our services after an update constitutes consent to the updated notice to the extent permitted by law.


We may occasionally update this notice. If we make significant changes, we will notify users in advance of the changes through the RespondEye application and other ThirdEye Gen, Inc product(s) or through other means, such as email. We encourage users to periodically review this notice for the latest information on our privacy practices.


After such notice, use of our services by users in countries outside the European Union will be understood as consent to the updates to the extent permitted by law.



Legal Process Overview

ThirdEye Gen, Inc discloses information to U.S. law enforcement in accordance with applicable law, its privacy notices, and its Terms and Use.


U.S. Law Enforcement


ThirdEye Gen, Inc will disclose account information to U.S. law enforcement where required by legal process issued pursuant to the Electronic Communications Privacy Act (“ECPA”) and other legal authorities. The ECPA prohibits ThirdEye Gen, Inc from disclosing certain categories of user data without legal process, such as a subpoena, court order, or search warrant. There are also certain exceptions to ECPA’s prohibition on sharing user data. For example, ThirdEye Gen, Inc. may proactively disclose user data in emergencies (as described in the Section on Emergency disclosure requests).


Additional ThirdEye Gen, Inc Resources


Law enforcement should contact the LERT through the Law Enforcement Portal (“Portal”) at Support@thirdeyegen.com The Portal provides the central point of contact for law enforcement to communicate with LERT specialists when submitting preservation requests, legal process, or emergency disclosure requests. Law enforcement may also use the Portal to obtain status updates on submitted legal processes or to ask questions.

Requesting Emergency Assistance


The Portal may also be used to transmit emergency disclosure requests to ThirdEye Gen, Inc. pursuant to 18 U.S.C. §§ 2702(b)(8) and 2702(c)(4). When submitting a request, law enforcement must accept the Terms and Conditions and certify that the request is, in fact, related to an emergency involving danger of death or serious physical injury that requires disclosure without delay of information relating to that emergency and that law enforcement is currently unable to obtain legal process.


ThirdEye Gen, Inc has processes in place to respond to emergency requests on a 24/7 basis. ThirdEye Gen, Inc may follow up with law enforcement upon receipt of an emergency disclosure request if information is missing from the request or if further clarification is needed. Accordingly, appropriate contact information should be provided so that ThirdEye Gen, Inc can follow up quickly.

Identifying an ThirdEye Gen, Inc Account


When submitting a legal process to Support@thirdeyegen.com, law enforcement should identify the specific account(s) implicated by the request. When possible, law enforcement should provide a unique identifier(s) associated with the account(s), such as email address and phone number. Names alone often are not unique identifiers, nor are dates of birth (to the extent collected). ThirdEye Gen, Inc may also be able to identify accounts that are relevant to a law enforcement investigation by searching for information related to a specific trip. For such requests, information such as user identification information named above, and a date, time.



ThirdEye Gen, Inc User Notice Policy


ThirdEye Gen, Inc will notify users of law enforcement requests for their data, except where notice is prohibited by the legal process itself, a lawful non-disclosure order (e.g., a court order under 18 U.S.C. § 2705(b)), or other applicable law, or for other circumstances that indicate non-disclosure within ThirdEye Gen, Inc discretion. For example, ThirdEye Gen, Inc may decide in its sole discretion not to disclose the existence of a law enforcement request, such as in emergency situations or situations involving harm to a minor.


In the absence of a basis for non-disclosure, ThirdEye Gen, Inc will proceed to notify the user of the request. Law enforcement should therefore take care to indicate any legal restrictions on disclosure in its submission of process to Support@thirdeyegen.com Specifically, law enforcement should:

  • indicate the absence of any objection to user notice.
  • provide a lawful non-disclosure order, or
  • identify another legal basis prohibiting user notice, such as language in the legal process itself or statutory language that prohibits user notice.

After expiration of a nondisclosure order or other basis for nondisclosure, ThirdEye Gen, Inc will provide notice to users regarding law enforcement requests for their data unless, in its sole discretion, ThirdEye Gen, Inc will withhold notice as noted above.


The notice that ThirdEye Gen, Inc typically provides to its users informs them that they have received a request from a law enforcement agency about their account and provides them with the name of the requesting agency. Users are also informed that ThirdEye Gen, Inc is required to respond to the lawfully issued process.


If ThirdEye Gen, Inc receives a National Security Letter (NSL) that is subject to a non-disclosure obligation of indefinite duration, it will notify the government that it is requesting review of the non-disclosure requirement in accordance with the NSL statute. If the government notifies ThirdEye Gen, Inc that it is no longer subject to the non-disclosure obligation, ThirdEye Gen,Inc will notify the relevant user in accordance with the above.


Guidelines for Requesting Information From ThirdEye Gen, Inc


As described above, legal process should be submitted to Support@thirdeyegen.com


To be valid, legal process submitted to ThirdEye Gen, Inc must generally:

  • be addressed to the Law Enforcement Response Team of ThirdEye Gen, Inc. 300 Alexander Park Drive, Princeton, New Jersey 08540
  • be issued by the appropriate authority.
  • be signed by the appropriate authority, such as a judge. Legal process must be signed pursuant to local court rules, including by an electronic or telephonic signature.
  • be dated
  • provide a date and time to return the responsive materials, if applicable, and
  • specifically identify the targeted account and the type(s) of information within the account to be disclosed. See the Section on Identifying an ThirdEye Gen, Inc Account for information about identifying ThirdEye Gen, Inc accounts and Section on Information Available for additional information about user information available from ThirdEye Gen, Inc

In addition, requests that do not have a valid legal basis, are overbroad, vague, or otherwise inappropriate will be rejected.


Subpoenas


Under ECPA, a subpoena may be used to compel the disclosure of “basic subscriber information,” as defined by 18 U.S.C. § 2703(c)(2). For additional information about the basic subscriber information ThirdEye Gen, Inc may produce, see the Section on Basic Subscriber Information.


There are three types of subpoenas that a governmental entity can use to compel disclosure of data from ThirdEye Gen, Inc: (1) an administrative subpoena authorized by a federal or state statute, (2) a federal or state grand jury subpoena, or (3) a federal or state trial subpoena.


Subpoenas must comply with the criteria specified above for legal process validity, including the requirement that they be issued by an executive branch agency or court with the power to issue such subpoenas. They must also be signed by a person authorized to sign subpoenas.


Court Orders


Under ECPA, a court order issued pursuant to 18 U.S.C. § 2703(d) (a “(d) Order”) may be used to compel the disclosure of all non-content records and other information related to a user account upon a showing of “specific and articulable facts” that “there are reasonable grounds to believe” that the “records or other information sought are relevant and material to an ongoing criminal investigation.” A (d) Order may also compel the disclosure of basic subscriber information. However, the contents of communications, such as messages between ThirdEye Gen, Inc partners and users, may not be disclosed in response to a (d) Order.


To be valid, a (d) Order must:

  • be signed by a judge.
  • be issued by a court of competent jurisdiction, and
  • state that it was issued pursuant to § 2703(d) or include a finding based on “specific and articulable facts” showing that there are “reasonable grounds to believe that the records sought are “relevant and material to an ongoing criminal investigation.

Search Warrants


Under ECPA, law enforcement may use a search warrant to compel the disclosure of content and non-content information. In other words, a search warrant can be used to acquire information available with a subpoena or a (d) Order and the contents of a user’s communications. Content is defined as “any information concerning the substance, purport, or meaning of [a] communication.” Content accordingly includes the body of text messages and other types of information that convey the substance of a communication. For additional information about the content information ThirdEye Gen, Inc may produce, see Section on Communications Information.


To be valid, a search warrant must:

  • identify the person or property to be searched (i.e., ThirdEye Gen, Inc).
  • identify any person or property to be seized (i.e., user account and records or content).
  • state the warrant was issued upon a finding of probable cause.
  • designate the judge to whom the warrant must be returned.
  • be signed by a judge, and
  • be served on ThirdEye Gen, Inc within 14 days of the date on which it was issued (for federal search warrants) or within the time frame specified for execution in the state from which the warrant was issued.

Preservation Requests


Under ECPA, law enforcement may seek the preservation of account records pursuant to 18 U.S.C. § 2703(f). Upon receipt of such a request, ThirdEye Gen, Inc will take steps to preserve any records or other information in its possession regarding the subject of the preservation request pending the issuance of legal process. A preservation is a one-time “snapshot” of the records or content in an ThirdEye Gen, Inc user’s account at the time we receive the preservation request, it is not an ongoing, real-time preservation of those records. ThirdEye Gen, Inc does not notify customers about requests to preserve their account information.


ThirdEye Gen, Inc will preserve any records or content in a user’s account for 90 days. ThirdEye Gen, Inc will extend that preservation an additional 90 days (for a total of 180 days), if requested to do so by law enforcement.


Preservation requests should be submitted to Support@thirdeyegen.com ,They must be dated and must specifically identify the targeted account and the type of information within the account to be preserved.


Emergency Disclosure Requests


ThirdEye Gen, Inc may voluntarily disclose user data, including content information, to a U.S. governmental entity if ThirdEye Gen, Inc has a good-faith belief that an emergency involving danger of death or serious physical injury to any person requires disclosure without delay of information related to the emergency. Law enforcement may obtain subscriber information or other records, including content information with an emergency disclosure request. The information disclosed must be limited to the amount necessary to specifically address the ongoing emergency.


To submit an emergency disclosure request, law enforcement must:

  • certify that they are authorized by law to obtain the requested records.
  • certify that the request is, in fact, related to an emergency involving danger of death or serious physical injury that requires disclosure without delay of information relating to that emergency.
  • certify that law enforcement is unable to obtain legal process in time to respond to the emergency, and
  • accept the Terms and Conditions, and
  • if required by law, follow-up with the legal process.

Emergency disclosure requests should be submitted to ThirdEye Gen, Inc using email Support@thirdeyegen.com for submissions. Because of its commitment to safety on its platform, ThirdEye Gen, Inc has processes in place to respond to emergency requests on a 24/7 basis.


Witness Testimony Requests


ThirdEye Gen, Inc includes a Certificate of Authenticity with its productions, which generally eliminates the need for live testimony to authenticate records. ThirdEye Gen, Inc accepts service of subpoenas seeking witness testimony through Support@thirdeyegen.com ThirdEye Gen, Inc may not be able to accommodate subpoenas for witness testimony served with fewer than 14 days advance notice.

Basic Subscriber Information


“Basic subscriber information” is defined in 18 U.S.C. § 2703(c)(2). Basic subscriber information includes information provided by users during the creation of an ThirdEye Gen, Inc account and information submitted or collected at a later date.


Basic subscriber information maintained by ThirdEye Gen, Inc for users may include:

  • user profile information (i.e., name, email, phone number).
  • usage information (i.e., date of account creation, and account status), and
  • “means and source of payment” (see “Billing Information” below for more details).

Basic subscriber information may be obtained with a subpoena, (d) Order, search warrant, or pursuant to an emergency disclosure request.


Device Information


Device information may be obtained from ThirdEye Gen, Inc with a (d) Order, search warrant, or pursuant to an emergency disclosure request.


User Information


User Information that ThirdEye Gen, Inc may provide includes:

  • User profile information
  • Date of account creation
  • Billing Information

Device and User information may be obtained with a (d) Order, search warrant, or pursuant to an emergency disclosure request.


Billing Information


Billing information includes “means and source of payment,” as specified in ECPA, as well as other billing information about user payment transactions on the App.


Means and source of payment information that ThirdEye Gen, Inc may provide includes:

  • Partial credit card (first six and last four of the credit card number) or bank account numbers.
  • Credit card expiration date.
  • Associated credit card zip code and
  • other payment instruments.

Because “means and source of payment” is considered basic subscriber information, it may be obtained with a subpoena, (d) Order, search warrant, or pursuant to an emergency disclosure request. “Means and source of payment” does not include information about payment transactions.


Other billing information that ThirdEye Gen, Inc may provide includes:

  • Information about particular transactions, like amount, date and time the transaction was made, and the payment instrument used. This billing information may only be obtained with a (d) Order, search warrant, or pursuant to an emergency disclosure request.

Location Information


ThirdEye Gen, Inc may collect GPS location information from the mobile devices of its users. A user's location information may be captured when ThirdEye Gen, Inc products are running on mobile devices on or off as long as the user is logged into account. Users have the option in their device settings to opt out of the collection of their GPS information, and if they choose to do so, the user's GPS will not be captured.


Available GPS location information may be obtained with a search warrant or pursuant to an emergency disclosure request only.


Other User Profile Information


Other user profile information about the user that ThirdEye Gen, Inc may provide include:

  • Rating(s) (one to five stars).
  • Written feedback/comments, and
  • Profile photograph(s).

Such user profile information may be obtained with a (d) Order, search warrant, or pursuant to an emergency disclosure request.


User Profile Information


ThirdEye Gen, Inc may retain the following information about its users:

  • Location, First and last name.
  • Device information (as described above), and

Such user profile information may be obtained with a (d) Order, search warrant, or pursuant to an emergency disclosure request.


Communications Information


ThirdEye Gen, Inc may capture certain information about communications between its product(s) users. This may include non-content records associated with such communications, or in the case of text messages through the app, the contents of those communications.


Records of communications may include:

  • GPS information.
  • Date and time of the communication.

Records of communications may be obtained with a (d) Order, search warrant, or an emergency disclosure request.


Contents of communications may include messages sent between ThirdEye Gen, Inc product(s) users. Contents of communications may be obtained with a search warrant or pursuant to an emergency disclosure request only.


Customer Service Records


Customer service records ThirdEye Gen, Inc may retain include:

  • Recordings of customer support calls, and
  • Other customer support communications.

Such customer service records are ThirdEye Gen, Inc business records, and are not covered by ECPA. Accordingly, these records may be obtained with a subpoena.



CHANGES TO PRIVACY POLICY

Each time you use the Site, the current version of this Privacy Policy will apply. When you use the Site, you should check the date of this Privacy Policy (which appears at the top of this Privacy Policy) and review any changes since the last version. Users can always refuse to accept the change to our privacy policy by terminating their use of the Site and our services offered via the Site. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you. Continuation of such use shall be considered acceptance of the change in the Privacy Policy. We will not materially change our policies and practices to make them less protective of your privacy without the consent of affected users.
